Madame Butterfly, the Betrayal: A Review of the Opera

Pinkerton is inspecting the home for him and his bride to be, Madame Butterfly. Upon finishing the inspection of the home, Pinkerton agrees to buy the home for 999 years, although he holds the right to cancel the agreement of the purchase during any month

The opera moves on, and we find that a wedding between Pinkerton and Butterfly is about to take place. Almost all of Butterfly's family will be coming to attend, however her uncle will not be coming due to the fact that he is a priest.

Pinkerton of course plans to marry Butterfly however, his true goal in life is to gain the love of as many beautiful women as possible, as he puts it, and he will not be satisfied until he captures the flowers of every shore. For this reason he retained the right to cancel the agreement any month. The time approaches that the stage will introduce you to the elegant Butterfly, have your opera glasses prepared.

Before you have the chance to see the beautiful bride Butterfly, you see the American consul who is with Pinkerton. He asks Pinkerton if he truly loves his bride to be. Pinkerton tries to say yes, but alas he cannot say for sure, but knows that he is mesmerized by her innocence, charm and beauty. He then speaks of having a true wedding with an American bride.

The Beautiful Butterfly graces the stage; Butterfly and Pinkerton are married with all of Butterfly's family in attendance. As the celebration of the wedding continues, Butterfly's uncle, the priest breaks in to the party and condemns Butterfly for renouncing her religion to marry Pinkerton. Butterfly's heart breaks and finds herself in the arms of Pinkerton being comforted.

Months and weeks pass Butterfly and Pinkerton stay happily married, Butterfly is beyond content, nearly exploding with joy with the marriage to the man that she loves so much. One day Pinkerton finds that he must leave to fulfill his service as a naval officer, and tells Butterfly that he will soon return.

As act three begins, we come to know that three years have passed since Pinkerton walked out the door for the last time. Butterfly faithfully watches out the window each day to see if his ship will come in. One day as she is watching out the window, she sees a figure that she recognizes walking up the path. No it is not Pinkerton coming up the path, but his good friend that she has known from the beginning as his friend the American Consul. She greets him excitedly hoping that he brings news from her husband. Unknown to Butterfly, the American Consul has been sent to her by Pinkerton to tell her that he has married an American woman named Kate, and that he would not be returning to her ever. Broken hearted, the American Consul Curses Pinkerton, and gives the news so hard to bear.

Crushed by the dishonor and betrayal she leaves the room only to come back carrying a child. She begs with the American Consul, she says that Pinkerton would not dare to leave his wife, and now child. After trying to convince him that Pinkerton would not leave her, she finally accepts the facts.

The story does not end here, but to find out the end of the story you will have to see Madame Butterfly for yourself. Lawsuits Filed for Faulty Durom Cups

In 2006 Zimmer Durom Cup Hip Implants were approved for use in the United States. Within less than 2 years, more than 12,000 patients were functioning using a Durom Cup as a replacement device for a defective hip joint. Although these implants had been used for 3 years in Europe prior to being approved in the U.S. and had exhibited a high rate of success, in the U.S. patients started developing problems, some almost immediately after surgery. Their doctors, looking for reasons why the implants failed, decided that the Durom Cup was a defective device.

Most states within the U.S. have laws designed to help patients who incur pain and suffering caused by defects in prosthetic devices. Per these laws, patients are entitled to compensation for their pain, medical expenses, and lost wages if it can be proven that a defective implant was to blame for their problems. Although Zimmer still stands fully behind its device based on its track record in Europe, it voluntarily pulled the product from the American market in July, 2008 in order to develop better training methods for doctors who insert the implants.

If you perform a search on the Internet for "Zimmer Durom Cup Lawsuits", you will find a host of attorneys who are looking to help file lawsuits against Zimmer on behalf of patients. As the number of cases of implant failures continues to grow, these attorneys have done their research and believe that they can file successful individual or class action lawsuits against the manufacturer.

In fact, one doctor reported that he found a cup that had loosened so much that it popped from its socket when he touched it. Zimmer cites the success of the cup in Europe as basis for its belief that there is nothing defective about the device, but physicians believe that almost 6% of all Durom Cups will fail and need revision surgery within the next couple of years.

People who own Zimmer stock have come to believe that the company was negligent in waiting until July, 2008 to pull the product off the American market. They and their attorneys feel it should have been pulled prior to January 22, 2008. Because of this belief, stockholders in Indiana have filed a class action lawsuit asking that damages be paid to those investors who bought stock between the January date and July, 2008 when the problem was announced and the product taken from the market.

Zimmer still pleads its case that its Durom Cup is not to blame for the surgical failures in the United States. Instead they contend that physicians did not receive adequate training for doing the procedure. Even so, in October, 2008, Zimmer announced that it had reserved $47.5 million to pay claims won in lawsuits against it. In July it was shown that the failure rate of cup implants could be as high as 5.7%. Zimmer states that this money is not being reserved for all patients and revisions but only for "revisions associated with surgeries that predate the company's voluntary suspension and which also occur within two years of the original surgery date." The resolution of this problem remains to be seen.
